By applying to or participating in the Bubbasafe Affiliate Program (“Program”), you agree to be bound by the following Terms & Conditions. These terms form a legally binding agreement between you (“Affiliate”, “you”) and Bubbasafe (“we”, “us”, “our”).


1. Eligibility & Approval

Participation in the Program is subject to approval at Bubbasafe’s sole discretion. We reserve the right to approve or reject any affiliate application for any reason, including but not limited to brand alignment, content quality, audience relevance, or compliance concerns.

Affiliates must be at least 18 years of age.


2. Affiliate Relationship

Affiliates act as independent contractors. Nothing in these Terms creates any partnership, joint venture, agency, employment, or fiduciary relationship between you and Bubbasafe.

You may not represent yourself as an employee, agent, or official representative of Bubbasafe.


3. Commission Structure

Affiliates earn commissions on qualifying purchases made through their unique affiliate tracking link.

• Commission rates start at 5%, with higher rates available for approved partners.

• Commission rates may vary by campaign, product, or affiliate level.

• Commission eligibility is determined by Bubbasafe and tracked via our affiliate platform.

Commission rates and structures are confidential and must not be publicly disclosed.


4. Qualifying Sales

Commissions are only paid on legitimate, completed purchases that:

• Are not cancelled, refunded, or charged back

• Are not self-referrals

• Are tracked correctly through the affiliate link

• Comply with these Terms

Bubbasafe reserves the right to withhold or reverse commissions for any transaction that violates these Terms.

5. Payments

Affiliate payments are issued according to the payment schedule and method outlined within the affiliate platform.

You are responsible for providing accurate payment and tax information. Bubbasafe is not responsible for payment delays caused by incorrect or incomplete details.


6. Promotional Guidelines

Affiliates must promote Bubbasafe in a truthful, ethical, and professional manner.

You agree that you will not:

• Make false, misleading, or unsubstantiated claims about Bubbasafe products

• Imply that Bubbasafe products prevent injury, illness, or guarantee safety outcomes

• Use spam, unsolicited messages, or deceptive marketing practices

• Bid on Bubbasafe brand keywords or trademarks without written approval

• Use unauthorised discount codes or incentives

All promotions must comply with applicable Australian consumer laws and advertising standards.

7. Disclosure Requirements

Affiliates must clearly disclose their affiliate relationship in accordance with applicable laws and platform guidelines (including ACCC and social media disclosure requirements).

Example:
“This post contains affiliate links.”

8. Brand Assets & Intellectual Property

Affiliates may only use approved Bubbasafe brand assets provided through official channels.

All trademarks, logos, content, and intellectual property remain the exclusive property of Bubbasafe. No ownership rights are transferred under this Program.


9. Termination

Bubbasafe reserves the right to suspend or terminate an affiliate’s participation at any time, with or without notice, for any reason, including breach of these Terms.

Upon termination:

• All affiliate links must be removed

• Outstanding commissions may be forfeited if earned in violation of these Terms

10. Modifications

Bubbasafe may update or modify these Terms at any time. Continued participation in the Program after changes are published constitutes acceptance of the updated Terms.


11. Limitation of Liability

To the maximum extent permitted by law, Bubbasafe shall not be liable for any indirect, incidental, or consequential damages arising from participation in the Program.


12. Governing Law

These Terms are governed by the laws of Australia, and any disputes shall be subject to the exclusive jurisdiction of Australian courts.
